Release of ‘coup’ suspects without charge follows continued abuse of anti-terrorism law, AI report

The release without charge of 22 government critics who were arrested and detained for months on allegations of terrorism illustrates the Ethiopian authorities’ continued abuse of the country’s anti-terror laws, Amnesty International said today.

The 22, released late on Tuesday, were among more than 200 people arrested in June after the killing of army chief Seare Mekonnen and Amhara Regional State President Ambachew Mekonnen – termed an attempted coup by the Ethiopian government. Most of those arrested have since been quietly released without being formally charged in court.

“The release of these 22 people without formal charges ever being filed against them is one consequence of the authorities’ continued misuse of the Anti-Terrorism Proclamation to arbitrarily arrest and detain government critics. For them to have been detained for four months without an iota of evidence being adduced is blatantly unjust,” said Fisseha Tekle, Amnesty International’s Ethiopia researcher.

Despite a number of somewhat questionable recipients — such as former US President Barack Obama, or the European Union — the Nobel Peace Prize continues to carry considerable symbolic meaning. For precisely this reason, awarding it to the young reformer hailing from Addis Ababa despite the stalled progress on his peace initiative is also the wrong choice. DW commentary.

Amnesty International is calling on the Ethiopian authorities to expedite the revision of the anti-terrorism law in line with international human rights standards. The revised law should among other things provide suspects with the right to bail pending trial, as well as ensure any criminal offence is clearly defined in accordance with international human rights law.

Five Ethiopian journalists arrested one month ago and arraigned in court on 3 October on charges of “incitement to terrorism” must be released immediately and unconditionally, after the police failed to produce any shred of evidence for their alleged crimes, Amnesty International said today.

AHRE open letter concerning house demolition and forced mass evictions in Oromia Region, Legetafo town

Association for Human Rights in Ethiopia (AHRE) pens this letter to express its concern following the demolition and planned demolition of thousands of houses in Legetafo town which left families on the street. This comes as a shock to AHRE which has warmly welcomed the overall reforms in Ethiopia, despite some pressing challenges.

AHRE has published numerous statements concerning forced displacements and other human rights concerns that recurred in the country and intensified to a larger scale in the past couple of years. The mass eviction against thousands of families is being conducted by officials themselves, unlike intercommunal conflicts and displacement in the rest of the country which involved the communities themselves, albeit reports of lower level of officials’ involvement.

AHRE has learned that the town was established in 2008 as a new special Zone along with seven other towns as part of the then Oromo People Democratic Organisation (OPDP) plan to curb the expansion of Addis Ababa to its outskirts. Against the local authorities’ claim that the houses were built violating the town’s master plan, several evicted families have bought the plots of land and built the homes before 2008. Many of them also say they have been paying hundreds of thousands in local currency to the town administration for utilities including electric and water bill, and other land payment fees.  Those evicted include children, mothers, new born infants, the elderly, and the handicapped. This is all the more disappointing when evictees were given a short notice (7 days) with no other options of a possible substitute residence.

Dear honourable Prime Minister Abiy, AHRE has in different occasions warmly welcomed and commended the incredible positive steps your admiration took towards bringing peace with Eritrea; releasing political prisoners; opening up the political space etc.  Ethiopia is signatory to The International Covenant on Economic, Social and Cultural Rights (ICESCR). The right to adequate housing mandated by the UN defines forced eviction as “the permanent or temporary removal against the will of individuals, families and/or communities from the homes and/or land which they occupy, without the provision of and access to appropriate forms of legal or other protection.” Thus, the measure is in clear violation of the right to housing which Ethiopia is signatory to.

We kindly urge your good office and your administration to issue an order to local authorities to immediately stop mass demolition and evictions; and compensate those families whose houses were demolished.

መከላከያ የኢሕአዴግ የመጨረሻ ምሽግ?

ጠቅላይ ሚኒስትር አብይ አህመድ የመከላከያና የደህንነት አደረጃጀት ህገመንግስቱ ላይ እንደተቀመጠው ባለፉት ሁለት አሰርታት ህዝብን ከማገልገል ይልቅ የወገንተኝነት ፖለቲካ ውስጥ እንደነበሩ ባለፈው ለፓርላማ ንግግር ሲያደርጉ አመላክተው ነበር።

ቀጥሎም የእነዚህ ተቋማት አሰላለፍ ከመንግስትና ከስርዓት ጋር የሚቀያየር ሳይሆን ወገንተኝነታቸው ለህዝብና ለሃገር ይሆን ዘንድ ማሻሻያ እንደሚደረግባቸውም ተገልጿል።

ይህን ተከትሎም የመከላከያ ሰራዊት ጠቅላይ ኤታማዦር ሹም የነበሩት ጀነራል ሳሞራ የኑስ በጀኔራል ሳአረ መኮንን፤እንደሁም የቀድሞ የብሄራዊ መረጃና ደህንነት አገልግሎት ዋና ዳይሬክተር አቶ ጌታቸው አሰፋ በጀነራል አደም ሞሃመድ መተካት ሊደረግ የታሰበው ማሻሻያ ጅማሮ ተደርጎ ሊታይ ይችላል።

ማሻሻያ ይደረግ ሲባል ከሚነሱ መሰረታዊ ጥያቄዎች መካከል ላለፉት ሁለት አሰርታት ከወገንተኝነት ፖለቲካ የፀዱ አልነበሩም የተባሉት የመከላከያና ደህንነት ተቋማትን ከዚህ መስመር ማውጣት የሚቻለው በምን አይነት ማሻሻያ ነው? የሚለው ቀዳሚው ነው።




“መከላከያ የኢህአዴግ የመጨረሻ ምሽግ”

የቀድሞ አየር ሃይል አዛዥ የነበሩት ሜጀር ጀነራል አበበ ተክለሃይማኖት ለቀድሞ ጠቅላይ ሚኒስትር ሃይለማርያም ደሳለኝ መከላከያ ማሻሻያ እንደሚያስፈልገው የሚያትት ደብዳቤ ፅፈው ነበር።የኢህአዴግ የመጨረሻ መደበቂያ ነው የሚሉት መከላከያም ሆነ ደህንነቱ ላይ ማሻሻያ ማድረግ እንደሚያስፈልግ ዛሬም ጥርጥር የላቸውም።

“መከላከያ የመጨረሻው የኢህአዴግ ምሽግ ነው።ፀረ ህገመንግስት የሆነ መመሪያም ነበራቸው” በማለት አንዳንድ የመከላከያ ባለስልጣናትም ፖለቲካ ውስጥ መግባታቸውንም ይጠቅላሉ።

ማሻሻያው መጀመር ያለበት ረዥም ዓመታትን ያስቆጠረውና ምንም እንኳ ጥሩ ነገሮች ቢኖሩትም በርካታ ችግሮች ያሉበት የአገሪቱ የውጭ ግንኙነትና ደህንነት ፖሊሲን ከማሻሻል መጀመር እንዳለበት ያስረዳሉ።

በማንኛውም ዘርፍ የሚደረግ ማሻሻያ ቀላልል እንዳልሆነ ይበልጥ ደግሞ እንደ መከላከያና ደህንነት ያሉ ተቋማት ማሻሻያ ከባድ እንደሚሆን አመልክተዋል።

ሁሌም የለውጥ ሂደት ላይ ለውጥ ደጋፊና ተቃዋሚ እንደሚኖር ሁሉ መከላከያና ደህንነትን በማሻሻል ሂደት ውስም በጥላቻና በዘረኝነት ፀረ ለውጥ ሃይሎች ሊኖሩ እንደሚችሉ ይገምታሉ።

ለዚህ መፍትሄ የሚሉት ለለውጥ ሂደቱ የሚወጡ መመሪያዎችም ይሁኑ ሌሎች አቅጣጫዎች ህገ መንግስቱንና ህገመንግስቱን ብቻ የሚከተሉ መሆናቸውን ማረጋገጥን ነው።

ከሁሉም በላይ አጠቃላይ የማሻሻል ሂደቱ በባለሙያ በቂ ጥናት ተደርጎበት የሚገባበት ለውጥንና የአገሪቱን ወቅታዊ እውነታ ያገናዘበ እርምጃ መሆን እንዳለበትም ያሳስባሉ።

እንኳን እንደ ኢትዮጵያ ባለ ታዳጊ አገር ባደጉ አገራትም የመከላከያና የደህንነት ተቋማት ሁሌም ወደ አንድ ወገን የማዘንበል ነገር የሚታይባቸው በመሆኑ የትኛውም አይነት ሪፎርም ቢደረግ እነዚህን ተቋማት ሙሉ በሙሉ ከወገንተኝነት እንደማያፀዳቸው ያስረዳሉ።

ቢሆንም ግን በአገሪቱ የህግ የበላይነትን አረጋግጦ በተቻለ መጠን የተቋማቱ ወገንተኝነት ለህዝብ እንዲሆን ማድረግ እንደሚያስፈልግ ያስረግጣሉ።




“ለውጥ አልተጀመረም አልተሞከረምም”

በመፈንቅለ መንግስት ሙከራ ተወንጅለው በእስር የነበሩትና በቅርቡ በይቅርታ የተለቀቁት እንዲሁም ማእረጋቸው እንዲመለስ የተወሰነው ብርጋዴር ጀነራል አሳምነው ፅጌ መከላከያን ስለማሻሻል ሲታሰብ ዋናው ችግር በወረቀት ላይ የሰፈረው ነገር ሳይሆን በተግባር የሚታየው ነው ይላሉ።

ለእሳቸው ይበልጡን ተቋማቱን የሚዘውሩት እነማን ናቸው? የሚለው ጥያቄ ወሳኝ ነው።

እሳቸው እንደሚሉት በወሳኝ ወታደራዊ ተቋማት መዋቅር ላይ የሚቀመጡት ሰዎች በቅርፅ ደረጃ ህገመንግስቱን መሰረት አድርጎ የህዝብና የሃገሪቱን ጥቅም ታሳቢ ያደረጉ ቢመስልም የመጡበት የፖለቲካ መስመር ተፅእኖ ግን በተጨባጭ የሚታይ እንደሆነ ይገልፃሉ።

በደህንነት ተቋማት በኩል ያለው ነገርም ከዚህ ይለያል ብለው አያምኑም።

“የማሻሻያው ጅምር ተደርገው በሚታዩት የቅርብ ጊዜ ሹመቶችም የነበረው ችግር መንፀባረቁን ቀጥሏል” ይላሉ ብርጋዴር ጀነራል አሳምነው።

ከዚህና ከተመሳሳይ ሃሳቦች በመነሳት መከላከያውንና ደህንነቱን የማሻሻል እርምጃ እንዳልተጀመረ ጨርሶም እንዳልተሞከረ ይናገራሉ ብርጋዴር ጀነራል አሳምነው።

በሌሎች አገራት በመከላከያም ይሁን በደህንነት ሰዎች ሲሾሙ ከብቃትና ለስርአት ታማኝ ከመሆን የበለጡ መስፈርቶች እንደሌሉና በኢትዮጵያ ግን ድጋፍ ሰጭው ሃይል ሳይቀር መዋቅሮች ከአንድ ፓርቲ ከህወሃት በወጡ ሰዎች መሞላታቸውን ይጠቁማሉ።

የአየር ሃይል አዛዥ የነበሩትና የብሄራዊ መረጃና ደህንነት አገልግሎት ዋና ዳይሬክተር ሆነው የተሾሙት ጀነራል አደም መሃመድን ሹመት እንደማሳያ በመውሰድ ቀጣዩን ብለዋል።

“እሳቸው ተሾሙ ማለት ተቋሙን ከታች እስከ ላይ ይመሩታል ማለት አይደለም።በየደረጃው ያለው መዋቅር የተሞላው በሌላ ሃይልና ፍላጎት ነው።”ይላሉ።

ብርጋዴር ጀነራል አሳምነው እንደሚሉት አማራ ወይም ኦሮሞ ብሎ ሾሞ ከሌላ ብሄር የወጣ መሆኑን ለህዝብ ለማሳየት መሞከር መሬት ላይ ያለውን እውነታ የመሸፈን ተፅእኖ ስላለው እርምጃው አደገኛ ነው።

ከላይ እስከ ታች ብቃትን መሰረት አድርጎ ከሁሉም ህዝቦች የተውጣጣ እኩል ውክልናና ስልጣንን የሚሰጥ አካሄድን መከተል ባለው የአገሪቱ ነባራዊ የፖለቲካ ሁኔታ እሳቸው አዋጭ የሚሉት አካሄድ ነው።

በሲቪል ሰርቪስ ኮሌጅ የሰላምና ደህንት ባለሞያ ሆኑት ዶክተር ጌታቸው ዘሩ ” አሁን እተደረገ ያለው ለውጥ የዛሬ ሳይሆን የቆየ ሂደት ነው ” ይላሉ።

ይሁን እንጂ አሁን ለውጡ ካለፈው ጠንከር ያለ ሊሆን እንደሚችል ይገምታሉ።

እሳቸው እንደሚሉት በፀጥታና ደህንነት ላይ የሚደረጉ ማሻሻያዎች ከሉዓላዊነትም ይሁን ከአገር ውስጥ ፖለቲካ አንፃርም በጥንቃቄ መታይት አለባቸው።በተለይ ደግሞ አካሄዱ አራቱም የኢህአዴግ አባል ድርጅቶች የተነጋገሩበትና የተስማሙበት መሆን ይኖርበታል።

የሚሾሙ ሰዎችም ተቋማቱን የመምራት ብቃት ያላቸው መሆኑን ማረጋገጥ አስፈላጊ ነው።ካልሆነ ግን ውስጣዊ ሽኩቻዎች ተቋማቱ ላይ ተፅእኖ ማድረጋቸው አይቀሬ እንደሚሆን ያስረዳሉ።

ምክንያታቸውን ሲያስቀምጡም “መንግስት የመሰረቱት እነዚህ ድርጅቶች እስከሆኑ ድረስ ስምምነታቸው ወሳኝ ነው” ይላሉ።
